Nobleix respects intellectual property rights and expects its users to do the same. We respond to clear notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA"). This policy forms part of our Terms of Service.
1. Designated Copyright Agent
Send all copyright infringement notices and counter-notices to our Designated Agent:
[Designated Agent Full Name]
Attn: DMCA Designated Agent, Nobleix
[Street Address], [City], [State] [ZIP], United States
Email: dmca@nobleix.com
Only DMCA notices should be sent to this agent; other inquiries will not receive a response through this channel.
2. Takedown Notice Requirements
To be effective, your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- Identification of the copyrighted work claimed to be infringed (or, for multiple works, a representative list);
- Identification of the infringing material and a direct link (URL) or other information reasonably sufficient for us to locate it;
- Your contact information: full legal name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act on the owner's behalf.
Incomplete notices may not be processed. Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees. Consider fair use before submitting.
3. What Happens After a Notice
- We review the notice and, if valid, remove or disable access to the material expeditiously.
- We notify the user who posted it and provide a copy of the notice (which may include your contact details).
- We record the notice against the user's account for repeat infringer purposes.
4. Counter-Notice Procedure
If you believe your content was removed by mistake or misidentification, you may appeal by sending a counter-notice to our Designated Agent containing:
- Your physical or electronic signature;
- Identification of the material removed and the location (URL) where it appeared before removal;
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- Your name, address, telephone number, and email; and
- A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which Nobleix may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
Upon receiving a valid counter-notice, we will forward it to the original complainant. Unless the complainant notifies us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the material within 10 to 14 business days after receiving the counter-notice.
5. Repeat Infringer Policy
Nobleix will terminate the accounts of users who repeatedly infringe copyrights. As a general guideline, an account that receives three (3) valid infringement notices ("strikes") within a twelve-month period will be permanently terminated, and the user may be barred from creating new accounts. We may terminate sooner, including after a single notice, for egregious or willful infringement. Strikes successfully challenged by counter-notice are removed.
6. AI-Generated Content
Users are responsible for ensuring that work they submit — including work created with the help of Nobleix AI or other AI tools — does not infringe third-party rights. Notices about AI-assisted content follow the same process above.
7. Changes
We may update this policy at any time; the "Last updated" date reflects the latest version.
